These Terms and Conditions (the “Agreement”) are a legal contract between the individual accepting and agreeing to this Agreement (“you”, “your”, “user”) and Buntai Investments LTD. (“Buntai”) that is the creator and provider of the KIDS MODE services (mobile application (“App”), browser extension (“Extension”), and website all collectively referred to as the “KIDS MODE Service”).
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE INSTALLING OR USING THE KIDS MODE SERVICE. THESE TERMS AND CONDITIONS GOVERN YOUR USE OF THE KIDS MODE SERVICE.
Acceptance of Terms
By using any portion of the Service, you agree to comply with and be bound by this Agreement and all policies and guidelines incorporated by reference.
If you do not wish to be bound by this Agreement, do not indicate your acceptance, and do not use the KIDS MODE Service.
KIDS MODE Service may link to third-party sites or content (collectively, “Third-Party Content”). Any use by you of Third-Party Content that is available via KIDS MODE Services is subject to the terms and conditions of any such Third-Party Content. You hereby acknowledge that Buntai has no control over and assumes no responsibility for Third-Party Content. You assume all responsibility and risk in connection with your use of Third-Party Content and Buntai hereby disclaims all liability to you or any third party in connection thereto. Buntai has no obligation to examine, review or monitor Third-Party Content and we are not responsible for the accuracy, completeness, appropriateness, or legality of Third-Party Content. For the removal of doubt, by using KIDS MODE Service you acknowledge that Buntai will not be liable for any damages, claims, and/or any other liabilities arising.
This Agreement is a legally binding agreement.
Requirements To Use
This Agreement and the Privacy Policy govern your use of the KIDS MODE Service. In consideration of your use of the KIDS MODE Service you represent and warrant that: (a) you are of legal age to form a binding contract and are not a person barred from receiving services under the laws of your state, province, or country of residence. and (b) your use of the KIDS MODE Service does not violate any applicable law or regulation. If you use the KIDS MODE Service, you represent that you can be bound by this Agreement. The KIDS MODE Service is for personal, non-commercial use. You agree that you are not using the KIDS MODE Service for or on behalf of any third party, or for any commercial purpose.
Amendments to this Agreement
Buntai may amend this Agreement or other policies that govern the Service from time to time. Any changes to this Agreement will be posted at https://kidsmode.net, and the posted Agreement will indicate the date the Agreement was last revised. If you do not agree to the changes, you must uninstall the applicable Extension and/or App and stop using the KIDS MODE Service. By continuing using the KIDS MODE Service after any changes to this Agreement are posted, you agree to be bound by those changes.
Privacy and your Personal Information
The personal information you provide Buntai through the Service is governed by KIDS MODE Privacy Policy (“Privacy Policy”). Please read the KIDS MODE Privacy Policy found at https://kidsmode.net. Your election to use the KIDS MODE Service indicates your acceptance of the terms of the Privacy Policy. You are responsible for all activities that occur in your user account, and you agree to inform us immediately of any unauthorized use of your user account by email to privacy@browserlock.net. We are not responsible for any loss or damage to you or to any third party incurred as a result of any unauthorized access and/or use of your user account, or otherwise.
Description of Service
KIDS MODE premium Service enables you to manage your kid’s screen time schedules, lock apps, set a time limit on app usage, website control, generate statistic reports of usage, and more. You can use the Service on any of your mobile devices and Internet browser supported by the Services.
Fees and Payments
The KIDS MODE Service is available under a variety of subscription plans free trial, premium etc. KIDS MODE offers a trial period of seven (7) days for the premium subscription.
Once your subscription has terminated it will be automatically renewed unless you downgrade your paid subscription plan to a free plan or choose not to renew the subscription. You may purchase and manage your subscription through Google Play or https://stripe.com/.
From time to time, Buntai may change the price of any KIDS MODE Service or charge for use of KIDS MODE Services that are currently available free of charge. Any increase in charges will not apply until the expiry of your then-current billing cycle. You will not be charged for using any KIDS MODE Service unless you have opted for a paid subscription plan.
Modifications to the service
Buntai reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the KIDS MODE Service (or any part thereof) with or without notice. You agreethat Buntai shall not be liable to you or to any third party for any modification or discontinuance of the KIDS MODE Service.
Proprietary Rights
You acknowledge and agree that the KIDS MODE Service and any necessary software used in connection with the KIDS MODE Service (“Software”) contain proprietary and confidential information, including copyrights, trademarks, know-how, etc., that is protected by applicable intellectual property and other laws. You further acknowledge and agree that content contained in sponsor advertisements or information presented to you through the KIDS MODE Service or by advertisers is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. Except as expressly authorized by Buntai or advertisers, you agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the KIDS MODE Service or the Software, in whole or in part.
Buntai grants you a personal, limited, non-sublicensable, non-transferable license to use the KIDS MODE Service on personally owned computers and mobile devices that are under your control, subject to the Terms and Conditions of this Agreement.
You shall not (and shall not allow any third party to) copy, modify, create a derivative work from, reverse engineer, reverse assemble, or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Software. You agree not to modify the Software in any manner or form, nor to use modified versions of the Software, including (without limitation) for the purpose of obtaining unauthorized access to the KIDS MODE Service.
Disclaimer of Warranties; Limitations of Liability
You expressly understand and agree that Buntai and its subsidiaries, affiliates, officers, directors, shareholders, employees, and other representatives shall not be liable to you for any injury, loss, claim, or direct, indirect, incidental, punitive, special, consequential or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Buntai has been advised of the possibility of such damages), whether based in contract, tort (including negligence) or otherwise, resulting from (i) the use or the inability to use the KIDS MODE Service; (ii)any error or omissions, mistakes or inaccuracies in the Service or results that are obtained from the use of the KIDS MODE Service including failure by the KIDS MODE Service to restrict or control access to the device on which it is installed; (iii) any loss or damage of any kind result of the use of the KIDS MODE Service or any content posted, transmitted, or otherwise made available via the KIDS MODE Service; (iv) failure by the KIDS MODE Service to restrict or control access on the device on which it is installed; or (v) any other matter relating to the KIDS MODE Service. Notwithstanding anything to the contrary contained herein, Buntai maximum aggregate liability to you for any causes whatsoever, and regardless of the form of action, will at all times be limited to the greater of (i) the amount paid, if any, by you to Buntai for the KIDS MODE Service in the 12 months prior to the action giving rise to liability or (ii) $20.
Buntai does not guarantee, represent, or warrant that your use of the KIDS MODE Service will be uninterrupted, timely, secure, or error-free. Buntai does not warrant that the results that may be obtained from the use of the KIDS MODE Service will be accurate or reliable.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT THE USE OF THE KIDS MODE SERVICES IS AT YOUR SOLE RISK. THE KIDS MODE SERVICES ARE PROVIDED ON AN AS-IS-AND-AS-AVAILABLE BASIS. BUNTAI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. BUNTAI MAKES NO WARRANTY THAT THE KIDS MODE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. NO ADVICE OR INFORMATION, WHETHER WRITTEN OR ORAL, OBTAINED BY YOU FROM BUNTAI, ITS EMPLOYEES, OR REPRESENTATIVES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.
Indemnification
You agree to indemnify, defend and hold harmless Buntai its officers, directors, shareholders, subsidiaries, affiliates, and employees, from and against all claims, demands, and expenses, including but not limited to reasonable attorneys’ fees and other legal expenses, in whole or in part arising out of or attributable to your use of the KIDS MODE Service (including any purchases you make within the App) or any breach of this Agreement by you or your violation of any law or rights of third party when using the KIDS MODE Service.
Governing Law & Jurisdiction
This Agreement shall be construed and enforced in accordance with the laws of the state of Israel, without reference to its conflicts of law principles. The courts located in Tel Aviv, Israel shall have exclusive jurisdiction to adjudicate any dispute arising out of this Agreement, and each party hereby expressly consents to the personal jurisdiction of such courts.
If for any reason Buntai does not enforce or rely on a right which Buntai has pursuant to this Agreement or to the general law, such nonenforcement shall not constitute a waiver or abandonment of that right.
A determination that any term of this Agreement is invalid or unenforceable shall not affect the other terms thereof.
